Founder's Pass Terms & Conditions

1. Overview
The Hollandaise Creamery Founder's Pass ("Founder's Pass") is a limited-edition digital membership pass offered by Hollandaise Creamery ("we," "us," or "the Creamery"), a Washington, D.C.-based artisan creamery. The Founder's Pass is delivered digitally via PassKit and can be added to Apple Wallet, Google Wallet, or accessed via a compatible digital wallet application. By purchasing a Founder's Pass, you ("Member," "you") agree to be bound by these Terms & Conditions. Please read them carefully before completing your purchase.
2. Eligibility
The Founder's Pass is available to individuals who are at least 18 years of age. By purchasing, you represent and warrant that you meet this age requirement, have the legal capacity to enter into a binding agreement, and are purchasing the pass for your own personal use.
3. Digital Delivery & Access
Upon purchase, the Founder's Pass will be delivered to you electronically via the email address associated with your order. The pass is issued through PassKit and can be saved to your Apple Wallet, Google Wallet, or other supported digital wallet. You are responsible for maintaining access to a compatible device and wallet application. The Creamery is not responsible for technical issues related to third-party wallet platforms, lost or replaced devices, or failure to save or back up your pass. If you lose access to your pass, contact us and we will reissue it to the original purchaser's verified email address.
4. What's Included
Each Founder's Pass entitles the Member to the benefits described on the product listing at the time of purchase, which may include but are not limited to:
- Early or priority access to new product releases and limited-edition drops
- Exclusive member pricing or discounts on select products
- Invitations to Creamery events, tastings, and behind-the-scenes experiences
- Seasonal gifts or perks at the Creamery's discretion
- Recognition as a founding supporter of Hollandaise Creamery
Specific benefits are subject to availability. The Creamery reserves the right to modify, substitute, or discontinue individual benefits at any time, provided that the overall value of the Founder's Pass is substantially maintained. Members will be notified of material changes via email.
Product lineup subject to change. The Creamery's product selection, including launch-day lineups, flavors, and any specific items previewed during pre-launch marketing, is subject to change, substitution, or discontinuation at our sole discretion before or after launch based on production capacity, ingredient availability, licensing, regulatory requirements, and other factors. Founder's Pass benefits apply to whatever products the Creamery offers from time to time and are not tied to any specific product advertised before launch.
5. Tulip Troll Illustration
As part of the Founder's Pass perks, each Member is entitled to a custom Tulip Troll illustration. To receive your illustration, you must submit the required details (including any reference photos or preferences) by Summer 2026. Submission instructions will be provided via email.
If you do not submit your details by this deadline, we may not be able to fulfill the Tulip Troll illustration portion of your Founder's Pass perks, as Creamery operations will be scaling up and our capacity to produce custom illustrations will be limited. The Creamery will make reasonable efforts to accommodate late submissions, but fulfillment after the deadline is not guaranteed.
6. Purchase & Payment
The Founder's Pass is a one-time purchase. The price is set at the time of sale and is non-negotiable. All payments are processed through our third-party payment processor. The Creamery does not store credit card or payment information directly. Each transaction is limited to one Founder's Pass per customer unless otherwise specified.
7. Duration & Validity
The Founder's Pass is valid indefinitely from the date of purchase for as long as the Founder's Pass program remains active. The Creamery reserves the right to discontinue the Founder's Pass program at any time upon 60 days' written notice to Members. In the event of program discontinuation, no partial or prorated refunds will be issued, but all benefits will remain active through the end of the notice period.
8. Non-Transferability
The Founder's Pass is strictly non-transferable. It is issued to and may only be used by the original purchaser. You may not sell, resell, gift, share, lend, assign, sublicense, or otherwise transfer your Founder's Pass or any associated benefits to any other person or entity. Any attempt to transfer the pass, including but not limited to posting it for sale on secondary marketplaces, auction sites, social media, or peer-to-peer platforms, will result in immediate and permanent revocation of the pass without refund. The Creamery reserves the right to verify the identity of the pass holder at the point of benefit redemption.
9. Anti-Abuse & Fair Use
The Founder's Pass is intended for the personal enjoyment of the individual Member. The following conduct is prohibited and constitutes grounds for immediate revocation of the pass without refund:
- Resale or commercial exploitation: Using the pass or its benefits for commercial purposes, resale, barter, or any form of profit beyond personal use
- Fraudulent redemption: Attempting to redeem benefits using falsified identity, duplicate passes, manipulated screenshots, or forged credentials
- Excessive or bad-faith use: Exploiting benefits in a manner that is unreasonable, disruptive, or clearly inconsistent with the intended spirit of the program (e.g., repeatedly claiming promotional offers through multiple accounts, exploiting technical errors in pricing or benefit systems)
- Multiple accounts: Creating or using multiple accounts or identities to obtain additional Founder's Passes or circumvent per-member limits
- Chargebacks in bad faith: Initiating a chargeback or payment dispute while continuing to use or retain pass benefits
- Harassment or misconduct: Engaging in abusive, threatening, or disruptive behavior toward Creamery staff, other members, or event attendees while using Founder's Pass benefits
The Creamery reserves the sole and absolute right to determine whether conduct constitutes abuse of the program. Revocation decisions are final. In cases of suspected fraud, the Creamery may pursue additional legal remedies as permitted by law.
10. Refund & Cancellation Policy
Due to the limited, exclusive, and digital nature of the Founder's Pass, all sales are final. No refunds, returns, or exchanges will be issued once the pass has been delivered, except as required by applicable law. If you believe your purchase was made in error, please contact us within 48 hours at [reveal email] and we will review your request on a case-by-case basis.
11. Allergens & Food Safety
To the extent that Founder's Pass benefits include access to Hollandaise Creamery food products, please be aware that our products may contain or come into contact with milk, tree nuts, wheat, soy, eggs, and other allergens. Members are solely responsible for reviewing ingredient lists and allergen disclosures for any products received or redeemed through the Founder's Pass. The Creamery is not liable for allergic reactions or adverse health effects resulting from the consumption of our products, provided accurate allergen information has been made available.
12. Limitation of Liability
To the fullest extent permitted by law, Hollandaise Creamery, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Founder's Pass, including but not limited to loss of profits, data, or goodwill. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Founder's Pass.
The Creamery is not liable for any loss of access to the pass resulting from device failure, third-party wallet platform outages, or changes to PassKit or wallet application functionality beyond our control.
13. Assumption of Risk
By attending any Creamery events or experiences associated with the Founder's Pass, you voluntarily assume all risks of injury, illness, or property damage that may arise from your participation. You agree to release, indemnify, and hold harmless the Creamery from any claims, damages, or expenses related to such participation.
14. Intellectual Property
All content, branding, imagery, and materials associated with the Founder's Pass and Hollandaise Creamery are the property of Hollandaise Creamery or its licensors and are protected by applicable intellectual property laws. Members may not reproduce, distribute, screenshot for resale, or create derivative works from Creamery materials, including the digital pass itself, without express written consent.
15. Privacy
We collect and use your personal information (name, email, and wallet data) solely for the purpose of issuing and administering the Founder's Pass, verifying membership, and communicating with you about your benefits. We do not sell or share your personal data with third parties for marketing purposes. Pass usage data may be collected through PassKit for the purposes of delivering and updating your pass. 16. Suspension & Revocation
The Creamery reserves the right to suspend or permanently revoke a Founder's Pass if the Member violates any provision of these Terms, engages in any prohibited conduct described in Section 9, or otherwise acts in a manner that is harmful to the Creamery, its staff, other members, or the integrity of the program. Revocation is at the sole discretion of the Creamery, is final, and does not entitle the Member to any refund. Prior to revocation for non-fraud-related violations, the Creamery will make a reasonable effort to notify the Member and provide an opportunity to address the issue.
17. Modifications to Terms
The Creamery reserves the right to update or modify these Terms & Conditions at any time. Material changes will be communicated to Members via email at least 14 days before they take effect. Your continued use of Founder's Pass benefits after such notice constitutes acceptance of the updated terms.
18. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the District of Columbia, and you consent to the exclusive jurisdiction thereof.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
